$1 Million Investment Made but Visa Application Denied

A Canadian National invested $1Million into a Hotel complex in the U.S. Represented by prior counsel, he applied for an EB-5 Visa, but the application was denied due to the lack of proper evidence and very poor quality of the submission.

The investor called us after his visa had been denied. After speaking with him in detail, we learned that the Investor had no desire for Lawful Permanent Residence as his business interests were all in Canada. All he wanted was to diversify his real estate holdings, and have the ability to live and work in the US for a period of three years, or until he had a reliable team in place to run the hotel business for the long term. He fully intended to run the day- to-day operations of the hotel for the interim, but had no desire to abandon or take up full time residence in the US for the long term.

After several trips to Vancouver, B. C to meet with the investor, his accountant and his Canadian counsel, Kripa Upadhyay, our Managing Partner helped them draft a new business plan, collected key documents in support of the application, and was able to secure an E-2 Visa as a Treaty Investor for the client.
